Head injury medical negligence

The initial signs of a head injury, for example as a result of a road traffic accident or assault, can sometimes be subtle. Skull fractures themselves can often be innocuous and will heal satisfactorily without any ongoing problems. However, they should suggest to the A&E doctor that the head has suffered a serious trauma and consequences from that should be suspected and monitored.

Concussion is the most common type of injury following direct trauma. The consequences of this might be mistaken for drunkenness because it can involve confusion, drowsiness, vomiting, amnesia and headache.

Straightforward head injury is very common in A & E Departments but the crucial thing is for the A & E doctor to identify, monitor and then refer the more serious cases for treatment. The failure to do so can cause brain injury or death and will invariably lead to a medical negligence compensation claim.

Head injury negligence claims will arise either from the failure to diagnose the seriousness of the head injury leading to inappropriate discharge from hospital or else, even with those patients who are admitted, the failure to undertake or interpret investigations. Failure to identify and deal with inadequate oxygenation is a specific problem causing subsequent and potentially profound personal injury.
