Delayed diagnosis of hip fracture - £2.5k compensation
Boyes Turner's medical negligence lawyers recovered £2.5k in compensation for a 32 year old man following a delayed diagnosis of his hip fracture.
He had attended the defendant hospital’s A&E department following a fall in which he landed on his right hip. Following assessment at A&E and x-rays he was reassured that he had only sustained a deep tissue jury and was discharged.
His symptoms did not improve and his GP referred him to a different hospital for repeat x-rays. They diagnosed a fractured femur. There was therefore a two week delay in diagnosis of the fracture during which time he was in considerable pain. He required an operation to insert a dynamic hip screw.
He took advice from Boyes Turner’s medical negligence lawyers and a compensation claim was brought against the first hospital for the failure to diagnose the fracture, which was clearly visible on the x-rays taken. Expert evidence was obtained from a Consultant Orthopaedic Surgeon who considered that our client's long term prognosis had not been affected by the delay in diagnosis. Boyes Turner’s lawyers sent a letter of claim to the hospital at the same time as making a settlement offer of £2.5k which was accepted by the hospital just under a month after the letter of claim was served.
There was no cost to our client in bringing the claim.
