Compensation claim secured after incorrect prescription drugs issued by pharmacist
Our client, Mrs C used to receive a regular prescription for eye drops for a dry eye condition.
In this instance she was given ear drops by the pharmacist when she presented with her usual prescription.
Mrs C was given the same size and type bottle with her prescription label on as was usual for her eye drops.
Mrs C applied the ear drops to her eyes as her prescription directed, and suffered with swollen eyes which were also red and stinging.
An admission of liability was received from the Defendant in May 2007 confirming that there had been a breach of the duty of care of the pharmacist in dispensing the incorrect medication.
The Defendant advised of their intention to obtain a specialist ophthalmologist report in July 2007 but also made an offer of £1.5k increased to £2.5k in settlement of the claim.
Following a delay to consider the offer, and the likelihood of any recurring symptoms being related to the application of the ear drops, Mrs C settled her medical claim in the sum of £3k.
