Successful claim - GP medical negligence leads to death - misprescription by GP
Boyes Turner's Medical Negligence lawyers recovered compensation for the family of a 71 year old man who died following the misprescription by his GP of a chemotherapy drug.
His hospital consultant had prescribed a four day course of Melphalan for multiple myeloma. His GP went on to prescribe two 28 day courses of the same drug without reference to the hospital consultant. As a result of these prescriptions his condition deteriorated within 12 weeks such that he died of the side effects of the chemotherapy.
The GP’s solicitors failed to accept responsibility for the over prescription putting the family in the position where Boyes Turner's Medical Negligence team had to obtain formal medical evidence and start Court proceedings. The Court proceedings were not defended and so judgment was entered.
A GP and an Oncologist were instructed and the case took 18 months to settle.
The medical negligence claim was settled for £20,000 reflecting the Court’s award for ‘bereavement’ of a spouse, funeral expenses, and the loss of help and assistance he would have provided to his wife.
