Delayed diagnosis of lung cancer - medical negligence claim
Boyes Turner's medical negligence team acted for a woman who suffered from recurring chest infections and was first referred to a chest physician in 1998 following a chest x-ray which had identified an abnormality.
The Consultant she saw dismissed the findings on the x-ray and did not diagnose any lung related condition.
In 2003 she complained of shortness of breath during a pre-operative assessment. A further x-ray was performed and indicated a lung mass. However the report was not acted upon and no further action was taken.
She continued to experience shortness of breath and finally in 2006, was diagnosed with a mucinous adenocarcinoma. She underwent a right upper lobectomy in February 2007. The delay in diagnosis of her lung cancer meant that she required more extensive and invasive surgery than would have been required had the diagnosis been made earlier.
The woman made a good recovery after surgery and opted not to have any adjuvant treatment after discussions with her consultant. She also suffered a psychological reaction as a result of the delay in diagnosis.
She approached Boyes Turner to make a medical negligence claim on her behalf and received £32.5k in compensation to reflect the more extensive and invasive surgery that had been required as a result of the negligence.
